Structure: |
The Specialized Courts against Corruption and Organized Crime consists of the Specialized Court of First Instance against Corruption and Organized Crime and the Specialized Court of Appeal against Corruption and Organized Crime. The former is composed of 16 specialized judges, while the latter is composed of 11 specialized judges. These courts judge with a panel of 5 judges, except when the legislation prescribes otherwise. The status of judges in these specialized courts is determined by the specific legislation. The employees of the administration (non-judges/magistrates) have the status of the civil servant.

Competence: |
The Specialized Courts against Corruption and Organized Crime exercise their jurisdiction over the following criminal offences: 1) Active and passive corruption of domestic and foreign public officials; 2) Active and passive corruption of high-level officials and local elected officials; 3) The exercise of undue influence over public officials; 4) Illegal benefits of interests of public officials; 5) False declarations of income, assets and interests; 6) Violation of equality in public procurement or auction participation; 7) Active corruption of witnesses, experts and translators; 8) Active and passive corruption of domestic judges, prosecutors, other judiciary officials, judges and officials of international courts, domestic and international arbitrators, and members of foreign juries; 9) Any criminal offence committed by structured criminal group, criminal organizations, terrorist organizations and armed groups; 10) Criminal charges against the President of the Republic, Head of the Parliament, Prime Minister, Member of the Council of Ministers, Judges of the Constitutional and High Courts, General Prosecutor, High Inspector of Justice, mayors, members of the Parliament, Deputy Ministers, members of the High Judiciary Council and High Prosecutorial Council, heads of central or independent institutions; 11) Criminal charges against the above ex-public officials.

Financial Autonomy: |
The Specialized Courts against Corruption and Organized Crime are independent judiciary institutions and have financial autonomy.

Structure: |
The Office of the High Inspector of Justice is an independent state authority. It is headed by the High Inspector of Justice, who is elected by the Albanian Parliament from the proposals of the Council of Appointments in the Justice System, for a 9-year term, without the possibility of re-election. He is assisted by the Deputy High Inspector of Justice and is appointed by the High Inspector for a 2-year term, with the possibility of re-appointment. No less than half of the inspectors are magistrates appointed there by the High Judicial Council and the High Prosecution Council. The rest of inspectors are appointed by the High Inspector of Justice. The High Inspector of Justice has the same status as the judge of the High Court, magistrate inspectors have the status of the judge of courts of appeals, while non-magistrate inspectors have the status of high-level civil servant. The rest of the employees of the administration have the status of the civil servant.

Competence: |
The High Inspector of Justice is the responsible state authority for the investigation of disciplinary offences and for the initiation of disciplinary proceedings against judges and prosecutors of all levels, members of the High Judicial Council, the High Prosecution Council, and the General Prosecutor. It is also responsible for the institutional inspection of courts and prosecution offices. The High Inspector of Justice initiates the investigation procedure based on the complaints of any citizen, legal person or public institution, the Minister of Justice, the General Prosecutor, any member of the High Judicial or Prosecution Council, the head of any court or prosecution office, as well as on his own initiative based on public data or inspection data. The High Inspector inspects the entire administrative and judicial activities of courts, judicial administration, prosecution offices, prosecution administrations based on the written requests of the High Judicial Council, High Prosecution Council, Minister of Justice, General Prosecutor or his yearly inspection plan. The High Inspector of Justice is responsible also for the: 1) Representation of the Office in relations with third parties; 2) Cooperation with other public and private institutions; 3) Drafting of general administrative guidance on the coordination of work between inspectors, administration and other institutions; 4) Drafting of non-binding guidance on specific cases investigated by the inspectors; 5) Reporting before the Albanian Parliament on the progress of its work; 6) Approves the yearly inspection plans; 7) Determination the necessary qualifications for the inspectors; 8) Methodological leading and oversight of the work of inspectors; 9) Investigates the disciplinary offences of the inspectors; 10) Leading and oversight of the entire administration of the Office as well as the appropriate committees; 11) Approval of other inspector’s decisions.

Financial Autonomy: |
The Office of the High Inspector of Justice is an independent state authority. Its budget is approved by the Albanian Parliament in accordance with the High Inspector’s proposal.
